U.S. Airlines Mandated to Automatically Refund Canceled and Delayed Flights

Why Were There New Rules on U.S. Airline Companies?

Transport Secretary Pete Buttigieg pointed to a situation where travelers’ flights are canceled and must then wait for days for another flight or pay more to fly home on another airline. Such circumstances violate passengers’ rights to access the service they have planned and paid for.

It is believed that these rules combined will save consumers from spending more than USD $500 million a year on non-transparent and unjustified expenses. The effect is to be observed, but the new rules reinforced the dedication of Biden’s broad administration attack to clamp down on “junk fees”.

What Do I Need to Know About the New Rules?

U.S. airlines

The new rules revolve around the concepts of service disruption and pricing transparency, and they are expected to fully take effect in two years.

Service Disruption

Airlines will be mandated to provide automatic cash refunds within a few days for the following interrupted airline services:

  • Canceled flights
  • Significantly delayed* flights: Any domestic flights that are delayed for at least three hours, or six hours for international flights.
  • Delayed* bag retrieval: Any bags or luggage that are not delivered within 12 hours for domestic or 15 to 30 hours for international flights
  • Miscellaneous: Fees for things such as seat selection, or an internet connection if the airline fails to provide the service

*Airline companies were responsible for deciding whether the delay was significant enough to be eligible for refunds. Now the delay period is standardized.

Airlines are given the autonomy to offer another flight or travel credit instead, with the acceptance of the offer from the customer side. Upon rejection, airlines should still proceed with a cash refund.

Pricing Transparency

Airlines and ticket agents must disclose upfront what they charge for checked and hand-carry luggage, and canceling or changing a reservation. On airline websites, the fees must be shown to the customers.

A rule also obliges airlines to inform passengers that they have a guaranteed seat at no extra cost, but they are still allowed to charge for seat selection. This rule extends to the issue where families are being separated on planes.

Some airlines charge extra for families to sit together, and the rule urged a change in airline companies’ customer policies that parents traveling with young kids should be able to sit together without an airline forcing them to pay junk fees.

The Transport Department (DOT) took this a step further by rolling out a dashboard that allows travelers to see which airlines help families with young children sit together without incurring extra costs. The dashboard rewards airlines with a green check if they can guarantee that whenever possible.
